Terms of Service

FNB Software Developer is a web development studio operated by Firaol Baneta in Sioux Falls, South Dakota. We provide custom development, ready-to-launch website templates, a no-code editor, online courses, and FNB Link Tree.

You must provide accurate information and be at least 13 years old to create an account. You are responsible for keeping your password confidential and for all activity that happens under your account. Tell us right away if you suspect unauthorized access.

Prices are shown in US dollars before checkout. Templates and courses are one-time purchases. FNB Link Tree is a one-time purchase that grants lifetime access to the feature. Monthly Care plans and any other subscription products renew automatically until cancelled.

We calculate every charge on our servers from our own price records, so the amount you are charged always matches the listed price at the time of purchase.

Subscription plans renew at the interval shown at checkout. You can cancel at any time from your dashboard; cancellation takes effect at the end of the current paid period and you keep access until then. We do not prorate partial periods unless required by law.

Refunds are governed by our Refund Policy, which forms part of these terms.

When you buy a template, you receive a non-exclusive, perpetual license to use it for one website — your own or a single client's. You may modify it freely. You may not resell, redistribute, sublicense, or publish the template itself as a template, theme, or starter kit.

Course material is licensed for your personal learning only and may not be shared, resold, or republished.

You keep ownership of everything you upload — text, images, logos, and links. You grant us a limited license to host, store, and display that content solely to operate the service, including serving your public Link Tree page. You confirm you have the rights to everything you upload.

Your use of the service is subject to our Acceptable Use Policy. Serious or repeated violations may result in content removal or account termination.

Custom development engagements are scoped in a separate written agreement or quote covering deliverables, timeline, revision rounds, and payment schedule. That agreement controls where it conflicts with these terms. Project deposits are non-refundable once work has begun.

We work to keep the service available and reliable but do not guarantee uninterrupted access. We may perform maintenance, change features, or discontinue parts of the service. If we retire a paid feature you have purchased, we will give reasonable notice and a fair remedy.

The service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or that it will meet a specific business outcome.

To the maximum extent permitted by law, FNB Software Developer is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

You may stop using the service and delete your account at any time. We may suspend or terminate an account that violates these terms, creates legal risk, or is used fraudulently. On termination your license to use our templates and courses survives for work you already paid for.

These terms are governed by the laws of the State of South Dakota, USA, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in South Dakota.

We may revise these terms from time to time. If a change materially affects your rights we will notify you by email or an in-app notice. Continuing to use the service after a change means you accept the revised terms.
